1、Introduce
Welcome to Podmalls!-
Podmalls values user privacy. In order to provide better operational services, we will collect and use your relevant information, including:
- Merchant — use Podmalls service to operate stores;
- Consumers — shop at Podmalls’ tech-supported stores;
- Partners — Develop apps for merchants to use, create stores on their behalf, recommend potential merchants to Podmalls, or otherwise help merchants operate or improve their Podmalls supported stores;
- Visitors — Visit the Podmalls website or contact anyone at Podmalls customer service. This Privacy Policy describes how we collect, use and share this information.
- We may update this Privacy Policy if our privacy-related practices change. If there are any significant changes, we will notify you (for example via Podmalls backstage or email). By using the Services of Podmalls, or transact with merchants that use the Services of Podmalls, you accept and agree to these Privacy Terms, or our Terms of Service, as applicable.
2、Merchant information
- If you are a merchant using Podmalls services to support your business, we will collect and use your personal information to enable you to use our platform and its services in order to help you better manage your business and your relationships with customers in general.
What information we collect about you and for what purpose
- We collect personal information when you register for Podmalls, use our platform, or otherwise provide personal information to us. In general, we need this information so that you can use our platform.

- In addition, almost all merchants using the Podmalls platform use non-Podmalls services to support their business (for example, using apps in our app Store, sales channels, payment gateways or logistics providers). Podmalls does not control how these services use your personal information, and you must carefully check your use of these services to ensure that they meet your privacy expectations. When you choose to use a non-Podmalls service, you will be prompted about what information will be shared so that you can decide whether to use the service or not.
Your rights to your information
- You can view and correct many of your personal information directly from the Podmalls background. If you are unable to view or correct certain information in the Podmalls background, please submit a data subject request through our requirements form.
- Since we need your personal information in order to provide you with our services, we will normally store your information when you use Podmalls products or services. If you close your store, stop paying your subscription fee or we terminate your account, we retain the information for three years before initiating the personal information removal process. We do not remove this information immediately because you may reactivate your account or there may be litigation or audit needs related to your business. If you contact us and request removal of your store information, we will begin the removal process after 90 days, unless we are required by law to retain specific information. Please note that after we anonymize your information, we may use non-personally identifiable information to improve our services.
- Finally, we have never and will never “sell” your personal information, and the term “sell” has the same meaning as defined by California law.
Information about your customers
- To support your business, we will collect and use personal information about your customers. In general, we collect and use such personal information only under your direction. Legally, we are “data processors”, “service providers” and “fiduciaries” for personal information processing, terms used in European, California and Chinese privacy laws. We will never use your customer’s information to market or advertise to your customers individually, unless they also use one of our applications or services directly. In addition, we have never and will never “sell” your customer’s information, and the term “sell” has the same meaning as set forth in California state law.

- Podmalls provides software for merchants to run their businesses. We collect and use information about you on behalf of specific merchants if you have visited or purchased products from stores that are supported by Podmalls. If you have questions about how a particular merchant or store uses your information, please visit its privacy policy.

Your rights to your information
- When you visit or purchase goods from a store that the merchant supports by Podmalls, the merchant that you visit or from which you purchase goods will legally control your information. As a result, Podmalls cannot determine, for example, how long your information will be retained, because that will be decided by the merchant. That is, Podmalls cannot help you access, correct, delete, or transfer your information without the merchant’s instructions. If you need to make a request for your personal information, please contact the specific merchant directly. If you send us the above request, we will forward your request to the relevant merchant and assist them to meet your request. However, if the merchant no longer exists, we may be able to help you directly. In addition, we have never and will never “sell” your Information, and the term “sell” has the same meaning as set forth in the laws of the State of California.
4、Partner information
- If you participate in the Podmalls Partner Program (such as participating in the development of application or theme templates for Podmalls merchants, referring potential merchants to us as a member of the Alliance, or helping merchants create or manage their stores), we will collect and use your personal information to enable you to use our platform and its services, And to help you cooperate with our merchants in general.

Merchants that use your services
- Our partners at Podmalls provide a number of important services to our merchants. When a merchant registers to use your service (for example, when they install an application developed by you), we will provide you with their personal information as instructed by the merchant. In this situation, we are providing this information to you on behalf of our merchants. You are responsible for protecting the merchant’s personal information and handling it securely in accordance with applicable laws, our partner agreements, API licenses and Terms of use, and any other terms that govern other Podmalls Services you may use. At the same time, Podmalls requires you to provide clear and transparent privacy policies to merchants so that they can understand your privacy practices and how you use the personal information they provide to you. If you develop an app that needs to be listed on the Podmalls App Store, that app also needs to have a privacy policy in place before it can be listed.

We will retain your personal information until you notify us to delete your personal information. If you need access to or need us to delete your personal information, please submit a data subject request through our request form. Please note that after we anonymize your personal information, we will continue to use non-personally identifiable information to improve our services.
6、Where we send your information
- We are a Chinese company, but we work with and process the data of individuals around the world. In order to conduct our business, we may transmit your personal information to regions outside your state, province or country, including the United States and Hong Kong. The data will be governed by the laws of the destination region. When we transmit your information across borders, we take steps to protect your information, and we attempt to send your information only to countries with strict data protection laws.
Transmission outside Europe and Switzerland
- If you are located in Europe or Switzerland, your personal information will be controlled by Podmalls, our Chinese company. Your information will then be sent to other Podmalls locations, as well as service providers located in other regions, including China (where our company is located), the United States and Hong Kong. When we transmit your personal information outside Europe, we will comply with European law.
- If you are located in Europe or Switzerland, when we send your personal information to China, this data is protected by Chinese law, and the European Commission has confirmed that the national legislation provides adequate protection for your information. If we subsequently send this personal information outside China, this information will be protected by contractual commitments comparable to those provided for in standard EU contract terms.
- If you are located in Canada, your personal information is protected by the Personal Information Protection and Electronic Documents Act of the People’s Republic of China, which is also recognized by the European Union. If we transmit your personal information outside China, the information will be protected by Canada’s Personal Information Protection Act and other relevant laws and regulations.

We are PCI DSS Level 1 Compliance Service Provider certified, which is the highest level of compliance certification, and our platform is reviewed annually by qualified third party security assessors.
- There is no absolutely secure method of network transmission or electronic storage. Therefore, we cannot guarantee the absolute security of your personal information.

8、How long do we keep your personal information

- In general, we remove information from merchants and partners within 90 days of receiving their request. We also remove information about businesses within 90 days of their cessation of activity for three years.
